The Chicago transfer stamp

Chicago charges a real property transfer tax, and the deed cannot be recorded without the city stamps. There are two components, a city portion and a Chicago Transit Authority portion. As a general matter the Department of Finance treats the city portion as the buyer's responsibility and the transit portion as the seller's, though the contract is where that actually gets settled between the parties. The Cook County and State of Illinois transfer taxes are separate items with their own stamps and their own math.

The part that catches sellers is sequencing. Chicago stamps are not available until the utility certification below is in hand. The Full Payment Certificate

This is the one that holds up Roseland closings more than any other. The Department of Finance requires a Full Payment Certificate on transfers of real property in the city, and that requirement applies whether the transfer is taxable or exempt. No certificate, no transfer stamps. No stamps, no recorded deed.

To get the certificate, the utility account on the property has to be clear. If there is an outstanding balance, it has to be paid for certification to complete. Some applications also require a field review or a final meter reading before the city will sign off, and on a house that has sat unoccupied or had its service shut off, that step is worth starting early rather than late. Vacant building registration

If your Roseland property is empty, the Department of Buildings expects it to be registered and maintained under the vacant building rules. Those rules reach the owners of all vacant buildings, owners of occupied buildings that have a vacant storefront, and mortgagees of certain vacant buildings. For a sale, the practical issue is that an unregistered vacant building with an open file is a known problem that a title company or a lender's counsel will ask about.
