What selling a rough house in Midlothian actually involves

Midlothian is straightforward on condition and strict on paperwork, and it helps to know which is which before you sign anything.

The village's transfer stamp is document based. The Village's own Transfer Stamp instructions enumerate everything the process takes: the Property Transfer Stamp and Water Certification Application, a copy of the deed, and payment of any outstanding bills. A physical pre-sale inspection does not appear anywhere in it. Nobody from the village is coming to look at the furnace, the roof, or the bathroom you stopped remodeling.

The detector question is handled by sworn affidavit instead. The application incorporates a notarized Affidavit of Compliance covering the Midlothian Village Code, the Illinois Smoke Detector Act and the Illinois Carbon Monoxide Alarm Detector Act, and the village is explicit that this is self-certified: "Whether they are in the home or not in the home, it doesn't hinder the process either way. The form simply needs to be filled out and notarized." The form itself gives you a line to initial stating that the property does not comply with the required number of smoke and carbon monoxide detectors, and it gives you a line to attest that the real estate has no structure on it at all. The transfer stamp is a scheduling problem

The village puts it plainly: when real estate is transferred or sold within Midlothian, a property transfer stamp must be obtained by the property owner or agent, and the stamp must be obtained before a deed can be recorded at the county. No stamp, no recording. A sale that ignores this does not get rejected dramatically. It just sits.

Requests go through the Village of Midlothian Public Records Center by selecting "Request Transfer Stamp" and attaching the completed application and a copy of the deed. The village asks that the application, the deed copy and payment for any outstanding bills come in a set number of business days before closing, and it publishes that number on its own Transfer Stamps page. Read it before you pick a closing date, not after. The application form also asks the seller for a property owner forwarding address and asks you to classify the property as single family, commercial, townhouse or condo, or industrial.

The village code lists exemptions from the stamp. They cover property acquired by or from a governmental body and transfers between governmental bodies, deeds or trust documents securing a debt or other obligation, deeds that without additional consideration confirm, correct, modify or supplement a previously recorded deed, deeds where the actual consideration is nominal and there is no change of occupancy, and deeds releasing property held as security for a debt. Midlothian does not publish the stamp rate or who bears the cost on that page, so that is a question for the village or your closing agent, not something to assume from how a neighboring town does it.

Water certification is part of the same form

There is no separate water office errand here. The water certification is built into the transfer stamp application. The affidavit carries a line that reads, "I hereby request a water payment certification. I acknowledge there is a twenty-five-dollar fee to obtain a full payment certificate," and the village posts the current fee on the form itself.

Payment for any outstanding bills has to accompany the application. That is the practical teeth of the process. Unpaid village accounts do not quietly disappear at a sale; they get settled as part of the package that produces the stamp. At a normal closing, the title company pays what is owed out of the sale proceeds, so it comes off the seller's side of the settlement statement rather than out of pocket in advance.

Empty houses and rented houses

Midlothian operates a Foreclosure Property and Vacant Property Registration, and the ordinance reaches owners, mortgagees and trustees alike: all of them must register with the village. The application is published on the Vacant Property Registration page. If a house has been sitting and nobody registered it, that gap belongs to the owner, and it is better found by you early than by the village during the stamp review.

Rental licensing has a wider reach than most people expect. Before engaging in the business of renting any dwelling unit, every owner of residential rental housing, whether occupied or vacant, must file a completed license application and owner's registration form with the village, with the appropriate fee for each rental property and unit. Occupied or vacant is the part that catches people. A unit that has been empty since the last tenant left is still rental housing in the village's eyes.
